This website (hereinafter the "Site") is published and operated by MH DIFFUSION SARL, its subsidiaries, and affiliated companies (hereinafter "Herbelin", "we", or "our"). For more information, please consult our Legal Notice.
1. Subject and Enforceability
All orders placed by individual customers, adult natural persons (hereinafter referred to as "Customers" or "Customer"), with MH DIFFUSION SARL via the Site and concerning the products and services we market, are subject to these General Terms and Conditions.
Placing an order implies the Customer's full and unreserved acceptance of these Conditions, as well as our Privacy Policy, our Cookie Management Policy, and all applicable laws, to the exclusion of all other documents (brochures, advertisements, catalogs) which are for illustrative purposes only.
The Customer declares, prior to placing an order, to be of legal age or to be in possession of authorization from their legal representatives, and to have full legal capacity to commit to these terms.
Herbelin reserves the right to modify these Terms at any time. The Terms applicable to any order are those in effect on the day the order is validated. Any subsequent modification of the Terms applies only to orders placed after its publication on the Site.
2. Customer Account Creation
Creating an account is not required to place an order.
If you create an account, the username must not include another person's name with the intent to impersonate them, nor be offensive, vulgar, or obscene. You are responsible for the confidentiality of your account information and for all activities conducted through it. You will immediately inform us of any unauthorized use or security breach related to your account.
By submitting your information during registration, you may choose to receive our communications by email. You can modify your preferences at any time from your account or via the unsubscribe link present in each non-transactional communication.
3. Intellectual Property
The Site and all its content (brands, illustrations, images, logos, texts, photographs, videos, codes, software) are the exclusive property of Herbelin and/or its affiliated companies (Montres Michel Herbelin SA), the sole entities authorized to use and exploit the intellectual property rights attached thereto.
Any total or partial reproduction, modification, transmission, or representation, without the express, written, and prior authorization of Herbelin or its affiliated companies, is strictly prohibited.
4, Responsibility
To the fullest extent permitted by applicable law, Herbelin disclaims all warranties, express or implied, other than those expressly stated herein.
Herbelin shall not be held liable for breach of its contractual obligations due to a fortuitous event or force majeure as defined in Article 1218 of the Civil Code and by French jurisprudence.
Herbelin's liability shall not be engaged in case of delay due to stockouts from one of its suppliers.
5. Links to third-party sites
Herbelin may provide links to other sites on the Site for informational purposes only. Herbelin makes no representations and disclaims all warranties regarding the accuracy, validity, adequacy, or legality of any elements present on these third-party sites.
6. Personal data and cookies

7. Severability
If any provision of these Terms and Conditions is found to be illegal, void, or unenforceable, that provision shall be deemed to be severed from these Terms and Conditions. The validity or enforceability of the remaining provisions shall not be affected, unless otherwise required by applicable law.
8. Language – Applicable Law – Mediation – Jurisdiction
These Terms are drafted in French and translated into English. In case of divergence between the two versions, the French version shall prevail.
These Conditions are governed by French law.
In the event of a dispute, Herbelin strongly encourages the Client to first contact its Customer Service to attempt to resolve the disagreement amicably.
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the Customer is informed that they may use a consumer mediation service free of charge in the event of an unresolved dispute:

The Customer may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/.
Failing an amicable settlement, Herbelin and the Client agree to bring the dispute before the competent French courts. These provisions do not deprive consumers of their right to initiate legal action in their country of residence or domicile, nor of their right to consumer protection measures provided by applicable legislation.
